Balancing legalism and leadership practice with regard to ethics

Conception of the responsibilities of healthcare professionals to their patients evolves with time due to a number of reasons. Evolution of career goals is one of the reasons. Changes in the family obligations and expression of moral damage are the other reasons. Legalism is the practice of strictly adhering to set moral code in a particular region or country. There exists a set code of conduct by the law that the medical personnel are expected to follow. These rules outline how medical practitioners including nurses, clinical officers or doctors should deal with their patients. Medical personnel change the conception of what their responsibilities are when moral issues arise (RentMeester, 2013, 10). Legalism rather is the translation of moral problems into legal problems. Legalism rather ensures that medical practitioners uphold moral ethics when dealing with their patients.

Leadership on the other hand is the art of creating both long term and short term strategies in treatment by health care providers. These leadership skills include conflict resolution, operation analysis, employee management and quality management. This art is mainly carried out by various persons in the management docket in the healthcare sector. The leaders in the healthcare sector should understand the complex business, management and policy issues with their main focus cast on improvement of the delivery of health care services. Legalism and leadership are co-related in that the leadership should ensure that the moral rights of the patients are upheld (RentMeester, 2013, 8). All medical personnel are expected to tackle various health issues that face them with professionalism but also considering various ethical issues.

Medical ethics is a system of set moral principles that apply values and judgment to the health care practice. Medical ethics give medical practitioners a direction to follow when administering treatment plans to their patients. For achievement of quality in health care legalism and leadership skills have to be balanced to ensure that bio-ethics have not been eroded. All leadership decisions made in health care facilities should be in line with the moral rights of the patients. The first and important issue that ensures that bio-ethics are adhered to in making decisions is involving the patients in the process of treatment. Consulting patients enables the leaders in health care facilities to establish the values, beliefs and preferences of the patients. With these values in mind it makes it easy to select a treatment plan that does not violate the moral standards of the patient (RentMeester, 2013, 5). An example is during organ transplants. Some religious views are against organ transplant and view this as immoral. A patient who has endorsed such views after consultation with a medical officer automatically puts the option of an organ transplant out of the possible treatment plans.

Essentially, decision making and enforcement of various plans should be done in line with various moral issues concerned. Transformations will only occur in the health sector if both legalism and leadership issues have to be equally put into consideration. The most successful health care service providers did not achieve that by luck. Success in the sector majorly lies upon a blend of the best managerial practices and consideration of moral and ethical issues. Personally I would ensure that all decisions made in the health facility are in line with the moral expectation of the client and hence ensure provision of the highest quality Medicare services
